I have received an email from an individual who wrote me the story of one of her relatives whose life was ruined by a court case and a freeze on all of their assets. The individual argues that their relative is innocent and their life was ruined unnecessarily and for no valid reason at all. For the benefit of this lady’s argument, I will assume she is right.
However, the Labour government is using such, potentially genuine cases, that may have been wronged by the law to give an excessive advantage to organised criminals. The problem is not with the law itself but in the way it is applied, the way the justice system handles it, and the proportionality of the enforcement actions.
The authorities have distorted justice and are creating significant dysfunction all over the justice system. Having given impunity to organized crime and corrupt politicians, anti-money laundering laws and asset freezes are being reserved for smaller fish who are getting trapped with lengthy court proceedings that give them no justice due to extensive delays. In addition, these laws have at times also been used in a targeted manner against anti-government individuals (I can not disclose details of such cases, for now).
The law and the system can be updated to avoid miscarriages of justice with unnecessary delays, but in essence and principle, the law is correct. The Labour government intends to scrap the law’s fundamental principle that a finance criminal is barred from making use of the financial and banking system. With Labour’s reforms, a suspected money launderer would still be able to use the financial system while they would be going through court proceedings.
