The EU AI Act protects artists against copyright infringement

Artists and fans of Studio Ghibli have raised concerns following a new trend in which people are using ChatGPT and other AI software to recreate images in the iconic Ghibli style. Fortunately, for artists based in the EU, EU law protects them from this kind of abuse. Articles 53, 105 and 106 of the EU AI Act protect the work of artists from the irregular and illegal use by AI.

Artists in Europe have to be right to be compensated if anyone makes use of their artwork through AI: this includes the appropriation of style and also artistic technique. Any use of artistic material would require compensation according to the law, unless agreed otherwise by the parties.

Sam Altman, the founder and CEO of ChatGPT, encouraged this trend by displaying a Studio Ghibli–styled AI-generated image as his social media profile picture. The US government also participated in the irregular trend by creating a cruel image of an ICE official deporting a woman.

One of the co-founders and artists of Studio Ghibli, Hayao Miyazaki is known to be against AI-generated art. Studio Ghibli prides itself in its long-standing tradition of hand-drawing every single frame of their cartoons. Their films include up to 70,000 hand-drawn scenes each.
