I am not going to waste time writing in detail why the replies by the Attorney-General and the Police to the Opposition are wrong. What can be pointed out with clear certainty that contradicts the fundamental premise of the State Advocate’s response for the Police and the Attorney-General is that the Police don’t need a magisterial inquiry to take action, and in fact, they are obliged to take action on criminal conduct.
The public hospitals deal between the government and Vitals and subsequently Steward International is a criminal matter and not a civil matter. The court has concluded clearly that there is at face value, criminal activity by both parties of the deal, yet the police don’t even need a court to establish this – they have executive powers to investigate crime wherever and however it is. Police Commissioner Angelo Gafa and the Attorney General are pretending that financial crime is a civil matter and are hiding behind many legal excuses to justify their inaction.
Surely, if they are to remain consistent with their reply, they are now obliged to take immediate and effective action once the Magistrate recommends criminal investigations and arraignments.
