Following the statements of Police Commissioner Angelo Gafa, Rosianne Cutajar will be arraigned in court over charges of fraud

In a recent video statement Police Commissioner Angelo Gafa gave to Lovin Malta, he said that the Police have always acted according to the evidence they had and have followed the law without fear or favor. He also said that people are prejudicing him.

Given that the Auditor General has released a report stating explicitly that Rosiane Cutajar’s job contract at the Institute of Tourism Studies was fraudulent, Police Commissioner Angelo Gafa now has documented evidence by which he can arraign Rosianne Cutajar in court. This situation is very similar to what Angelo Gafa faced when the Standards Commissioner wrote that the previous Education Minister, Justyne Caruana, and her permanent secretary, Frank Fabri, had potentially committed a crime. However, Angelo Gafa refused to take any action.

According to Angelo Gafa’s own statement he gave to Lovin Malta, the police would now already interrogate Rosianne Cutajar in their preparation to arraign her to court. I’m sure Gafa will do his best to find an excuse to refuse to do his job again, so allow me to help him out with some pictorial infographics from the criminal code. Any lawyer who may like to pitch in with this is welcome.


There is also another important aspect to this story. When a court found out that the state was defrauded in the public hospital deal, the government was pressured to begin the process of recouping the money that was stolen from it. The Nationalist Party has already made such a proposal in parliament, and this is something to which the State Advocate would by default have to agree given the conclusions are by the Auditor General.
