As revealed by Heritage Malta Chairman Mario Cutajar himself, Minister for Agriculture Anton Refalo gave back the British stone-marker to the government via negotiations with the Superintendent of Cultural Heritage Kurt Farrugia. The Superintendent of Cultural Heritage has the legal and executive power to order the Police to investigate the theft of cultural heritage and charge the suspects in Court.
If the Superintendent of Cultural negotiated back the British stone-marker, he is legally bound to report to the Police that a crime has been committed. As of the moment the Superintendent informs the Police of the crime, the Police have to file a report, conduct an investigation and charge the suspect in Court according to the Cultural Heritage Act.
There is no legal way by which Anton Refalo can avoid prosecution for his theft irrespective of your personal opinion of him or your about anything else. If Anton Refalo is not taken to court someone, somewhere is obstructing justice.
