The new Minister for Justice, Clifton Grima, held a meeting with the Venice Commission yesterday and stated that he will be working with the Commission to strengthen the independence of Malta’s specialised tribunals.
You don’t need to work to make tribunals “more independent”: they are either independent or they are not. Independence, according to the Labour government, translates into autonomy only as long as the entity safeguards the interests of the government.
Malta’s Data Protection Commissioner has become an extension of criminal interests, as the entity is currently being used by the Italian Mafia to attempt to censor a story that we have published. Throughout its history, the entity has served as an extension of the Labour government and its interests, issuing censorship notices against this press outlet over stories on Yorgen Fenech. Now, the entity has issued a decision in favour of Mario Gennaro’s associate.
Last year, we published a story about Mario Gennaro, the Mafia pentito who repackaged himself and opened gambling companies in Spain aimed at African customers. We also mentioned his associate, Margherita Simona Giudetti. The pair have built a gambling business mostly based on African customers, using shady cryptocurrency blockchains such as Tron to conduct their business. Despite the details being publicly listed, the Information and Data Protection Commissioner sent us a very bizarre legal document asserting that we should not disclose the details of Margherita Simona Giudetti, who is acting as Mario Gennaro’s front. You can find the very bizarre decision here.
Obviously, we are not going to abide by the decision, and we no longer take this entity seriously. It is deliberately writing legal documents aimed at censoring our content, irrespective of the details and information at hand. The entity is being used by the Labour government to put pressure on us and restrict our journalistic and investigative work.
What is even more concerning is that this Labour-leaning entity has chosen to use complaints by foreign organised criminal organisations to attack a local journalist: an unprecedented form of treacherous behaviour.
Our position in reaction to this decision is that we will increase our investigative efforts into Mario Gennaro and his associates, and we no longer recognise the IDPC as a legitimate state entity, but rather as an extension of the Labour government’s criminal interests. Anyone submitting complaints against our work to the IDCP will be wasting their money and time.
