Strangely enough, the Attorney-General is usurping her authority by ordering the State Advocate not to appeal Judge Giovanni Grixti’s decree that hands over Joseph Muscat parts of the Vitals and Steward Magisterial Inquiry. Instead of respect the State’s Advocate decision to appeal Judge Grixti’s decision, the Attorney-General has been busy photo-copying parts of the inquiry herself which she duly handed over to Joseph Muscat.
NGO Repubblika which demanded the Magisterial Inquiry in the first place has been refused a copy of the Inquiry. This week they made a court submission protesting this fact and the fact that Joseph Muscat is now in the privileged situation where he is the only suspected individual in the case of having a copy of the inquiry. You can read Repubblika’s court submission here.
The Attorney-General could avoid all these legal conflicts and ambiguity by simply publishing the Inquiry in its entirety. Somehow, Joseph Muscat still keeps managing to be the privileged exceptions in many legal situations.
