The UNSC report on oil smuggling in Libya has stated that legally, a Maltese Court has violated sanctions when it released the assets of Mutassim Gaddafi in Malta to the Libyan government of Tripoli. Mutassim Gaddafi held up to $100 million in a company based in Malta called Capital Resources Limited Malta with its bank accounts held at Bank of Valletta.
The Maltese Court released these assets to the Libyan government of Tripoli in 2022 but the decision was appealed by Gaddafi’s widow, Safiya Ferkash Mohammed. The case in Court is still ongoing.
Undoubtedly, if the assets are released to Gaddafi’s widow, the Maltese Court would once again be violating existing sanctions on Gaddafi’s assets.
