In a recent article, we criticised Judge Edwina Grima for being lenient with Yorgen Fenech’s defence lawyers while being steadfast and, at times, even challenging towards the prosecution. Yesterday, we have learnt through Court proceedings that the prosecution didn’t even prepare transcripts of Melvin Theuma’s recordings with Yorgen Fenech and Johann Cremona.
The Judge gave the Prosecutors a dressing-down for their deficiency. The Prosecutors defended themselves by saying that the courtroom audio is inadequate, and this is also correct.
However, the fact that the courtroom audio is not up to standard is not an excuse for failing to write down your transcripts. Attorney-General Victoria Buttigieg should be ashamed of this incredible deficiency in what is undoubtedly one of the most important court cases in Maltese history.
The Attorney-General has proven herself to be highly incompetent multiple times and also has a record of gross mistakes that are highly suspicious in their intent. In addition, the Attorney-General has not even shown up in Court for this case, following the example of Police Commissioner Angelo Gafà by leaving their subordinates to tackle high-profile suspects.
The cowardice and incompetence: a mixture that often results from, or is conditioned by, malice.
If we are to be grateful for small mercies, at least the Attorney-General did seems to have done some work on Yorgen Fenech’s case. The Prosecution did no preparation—let alone any investigative work—on the Vitals case, in what seems to be a clear action intended to give Joseph Muscat and his corrupt friends a very easy case.
Then there are cases like Rosianne Cutajar’s, where the Attorney-General explicitly refused to prosecute.
All hell would break loose if Yorgen Fenech goes free. Victoria Buttigieg has the historical essence of a Marie Antoinette: someone so malicious and imbecilic that their actions could easily prompt a revolution.
