Yesterday in Court, Yorgen Fenech’s defence lawyer Charles Mercieca lied to the jury about Melvin Theuma refusing to testify in Court over the phantom job case. Melvin Theuma attended the Court proceedings against Keith Schembri and Sandro Craus and was willing to testify.
The request to prevent Melvin Theuma from testifying came from Keith Schembri’s lawyers, and Magistrate Monica Vella accepted it. At no point did Melvin Theuma refuse to testify in this case.
So far, Keith Schembri and Sandro Craus have got away with the phantom job given to Melvin Theuma due to a very bizarre judgment by the Magistrate, who concluded that although the evidence showed that the phantom job had been given and that Theuma was being paid despite not reporting for work, the prosecution had failed to prove a common intention between the accused to commit fraud. The Magistrate also concluded that Theuma himself did not have the intention to defraud the government.
This bizarre sentence is currently under appeal by the Prosecutor.
