Legal experts have informed The Maltese Herald that the constant lack of cooperation by the prime investigator of the Vitals and Steward’s Magisterial Inquiry, Jeremey Harbinson, could jeapordise the whole Court case and make the investigation inadmissible. Jeremy Harbinson has recently been fined €500 for failing to appear in Court. He says he fears for his life if he comes to Malta.
In addition, if the Court deems that the Magisterial Inquiry is inadmissible as evidence, the case risks collapsing because the Police did not present any other evidence.
Legal experts have also informed The Maltese Herald that it is highly unusual for the Prosecutor and the Police to arraign individuals in Court exclusively on the back of a Magisterial Inquiry without having conducted any parallel investigations. The Prosecutor’s whole case in Court is based on the Magisterial Inquiry.
Jeremy Harbinson was chosen to lead the Magisterial Inquiry by Magistrate Gabriella Vella and has billed the Maltese Courts with his company Habrinson Forensics up to €11 million for an investigation that lasted up to five years. The Labour Party is insisting that there was no corruption involved in the deals despite a verdict by the local Courts deeming the public hospitals concession contracts awarded to Vitals and Steward Health Care as fraudulent.
